A filing-date-aware guide to Portuguese nationality by descent after the law changes that took effect on 19 May 2026.

Portuguese nationality law changed again in 2026. Organic Law No. 1/2026 entered into force on 19 May 2026, changing descent categories and transitional treatment. Older guides can therefore send a new applicant toward the wrong form or legal test.

The Ministry of Justice states that applications submitted after the new law took effect follow the revised rules, while pending proceedings are generally assessed under the former wording. Some implementation details may depend on complementary regulation and official interpretation. Confirm the current category before ordering documents.

What changed in May 2026

The Justice Ministry’s announcement explains that the revised law altered several grounds for acquiring nationality and extended a nationality opportunity to great-grandchildren of an original Portuguese citizen. It also removed or changed other routes. A headline about a newly included generation does not establish that every great-grandchild qualifies: the statutory conditions, proof of relationship and implementing instructions still control.

Because the reform is recent, use the date shown on the official Justice or IRN page and retain a copy of the instructions relied on when filing.

Start with the correct family category

Write a simple family tree from the original Portuguese citizen to the applicant. Identify whether the connection is through a parent, grandparent, great-grandparent, adoption or another legally recognised relationship. Then answer:

  • Was the ancestor an original Portuguese citizen, and is the Portuguese birth registration available?
  • Are all intermediate relationships recorded in full civil certificates?
  • Did any person change a name, marry, adopt or correct a record?
  • Was an earlier nationality application already pending on 19 May 2026?
  • Does the current official category require an additional connection, declaration, registration or criminal-record check?

Do not reuse a sibling’s old checklist without checking the law and the applicant’s own filing date.

Build the Portuguese record chain

The Portuguese ancestor’s civil registration is the anchor. Search the competent conservatória or Portuguese archive using the person’s full name, parents, parish or municipality and approximate date. For every connecting generation, obtain full certificates that show parentage.

Nigerian and other foreign public documents may need authentication and Portuguese translation according to the current IRN instructions. Names must connect coherently across the file. Where a marriage, recognition of parentage or name change was not registered in Portugal, ask whether prior transcription or another civil-registry step is needed.

Criminal-record documents have limited validity. Order time-sensitive evidence after confirming the route and likely filing window.

Choose the authorised filing channel

The Justice portal identifies registry offices, mail and Portuguese consular channels for applicable nationality processes. Its online nationality service is intended for authorised lawyers and solicitors. A person applying without a representative should follow the official non-represented channel for the category rather than sharing identity documents with an unofficial portal.

Verify the payee, fee and address immediately before submission. Keep a full scan, postal proof or electronic receipt and the process number. The ability to track a file does not guarantee a processing date or outcome.

Pending applications and professional advice

A file already pending when the 2026 law entered into force may be assessed differently from a new filing. Do not withdraw and resubmit solely because a newer online summary appears more favourable. First obtain advice about the transitional provision and the procedural consequences.

Professional advice is particularly useful where the line reaches a great-grandparent, a parentage record was created late, an ancestor’s Portuguese registration is missing, there is a criminal history, or an older application is already in progress. Verify that the professional is authorised to practise in the relevant jurisdiction.

Can a great-grandchild now apply for Portuguese nationality?

The law effective 19 May 2026 introduced an opportunity for great-grandchildren of an original Portuguese citizen, but the category’s full legal conditions and current implementation guidance must be checked before filing.

Which law applies if my application was already pending?

The Justice Ministry states that pending proceedings generally continue under the former wording, while post-entry applications use the revised law. Individual procedural facts can require legal analysis.

Can I submit the online application myself?

The official online nationality channel is for authorised lawyers and solicitors. Applicants without a representative should use an applicable registry, mail or consular route published by the Justice authorities.

Do Portuguese documents need an apostille?

Portuguese domestic records do not need foreign authentication for use in Portugal, but Nigerian and other foreign documents may need legalisation or apostille and translation. Follow the current category checklist.

Does a Portuguese surname prove eligibility?

No. Eligibility depends on a legally documented relationship to a qualifying Portuguese citizen and the requirements of the applicable nationality category.
