Residence in Europe

Understand temporary residence, permanent status and EU long-term residence before planning a move within Europe.

“Residence in Europe” is a useful everyday phrase, but not a legal status. A Nigerian national normally receives permission from one country for a defined purpose. The document, rights and renewal conditions follow that country’s law and, for some categories, EU rules.

Three levels of status

Temporary residence is usually linked to work, study, family, research or another approved purpose. It can be time-limited and conditional. Losing the underlying job, ending a course or separating from a sponsor may affect it, although safeguards and alternative routes can exist.

National permanent residence or settlement is granted under the destination country’s rules. It often follows several years of lawful residence and may require language, integration, income or insurance evidence. The exact label is less important than the statute and rights behind it.

EU long-term resident status is a coordinated status under Directive 2003/109/EC in participating Member States. It is distinct from national permanent residence and has its own eligibility and mobility framework. Read the dedicated EU long-term resident guide before comparing them.

What your residence rights depend on

Never infer rights from the appearance of a card. Check the decision letter and legal category. The answers to these questions matter:

Can you work?
Some permits allow unrestricted employment; others name an employer, restrict hours or require separate authorisation.
Can family join?
Eligibility, income, housing and relationship evidence vary with the sponsor’s status.
How long may you be absent?
Extended travel can interrupt residence continuity or cause a status to lapse.
What triggers renewal?
You may need to show that the original purpose continues, plus income, insurance, study progress or registration.
Does the period count toward settlement?
Some categories count fully, partly or not at all. Confirm this at the beginning, not after several years.

A first-year residence checklist

Arrival is not the end of the immigration process. Depending on the country, a new resident may need to register an address, collect a permit, enrol for tax or social security, arrange compliant health cover and notify the authority of changes. Put every expiry and reporting deadline in a calendar.

Keep a residence file with passport copies, entry evidence, cards, decisions, tenancy documents, payslips, tax records, insurance, school records and travel dates. These records can later prove lawful and continuous residence. Scan them, but retain originals where the authority may request them.

A residence card is not an EU passport

A permit from one country may facilitate short travel in parts of Europe, but it does not normally let a non-EU national relocate permanently to any other Member State. A second country can require its own application, assess employment or resources and issue a new permit. Even holders of EU long-term resident status must follow the second country’s procedure.

This distinction is especially important for remote workers. Permission to reside in one country does not automatically create permission to live or work physically in another, and tax or social-security obligations can arise separately.

Questions for a long-term plan

  • Which authority issued the status, and what is its exact legal name?
  • What event could end it: job loss, graduation, relationship change or long absence?
  • Which family members are eligible, and can they work?
  • When does renewal open, and what evidence must cover the full period?
  • Does this category lead to permanent residence?
  • Would citizenship later require a different residence calculation?

These questions turn a vague European ambition into a country-specific status plan.

Residence in Europe: frequently asked questions

Can one EU country issue a residence permit for all of Europe?

No. Residence permission is generally issued by a particular country. It may support limited travel, but moving to another country normally requires compliance with that country’s rules.

Is residence the same as tax residence?

No. Immigration status and tax residence are separate questions. A person may create tax obligations based on presence, home, work or treaty rules even when the immigration document uses different tests.

What happens if my passport expires before my permit?

Rules vary. Renew the passport early and ask the issuing authority how to update the permit record. Do not travel until you know which documents are accepted for re-entry.

Does study time count toward permanent residence?

It depends on the country and the status being sought. Some systems count study residence differently. Check the statutory calculation for your exact permit.

Should I keep old residence cards?

Yes, unless an authority requires surrender. Old cards, decisions and entry records can help reconstruct lawful residence and absences in a later application.
