Moving to Spain usually involves a national visa matched to a specific purpose. Some routes begin with an employer or family sponsor obtaining authorisation in Spain; others begin at the competent Spanish consular post. Starting in the wrong place can waste months even when the applicant is otherwise eligible.
Where does the procedure start?
Ask whether the route requires a prior residence or work authorisation from an authority in Spain. An ordinary employer-sponsored case often begins with the employer. Some family-reunification cases begin with the resident sponsor. Study, non-working residence and certain telework applications commonly use a direct consular stage, subject to the official category rules.
The national visa page of the competent embassy or consulate should identify the form, fee, appointment route, translations and who must appear. Instructions from a Spanish post in another country may not describe Nigerian submission arrangements.
Employment and highly qualified work
An ordinary employee route is tied to a real employer, contract and prior authorisation where required. Labour-market considerations, occupation rules and the employer’s compliance can matter. Verify the company through independent Spanish sources before sending personal records.
Highly qualified professionals, intra-company transfers, researchers and entrepreneurs may use procedures under Spain’s mobility and entrepreneurship framework. Eligibility is based on the role, qualifications, business facts and responsible Spanish authority–not on a recruiter calling the candidate “highly skilled”.
Self-employment requires a credible activity, investment plan, qualifications and licences where necessary. Registering a business name is not the same as proving a viable self-employed residence case.
International telework
Spain’s international telework route is designed for eligible remote activity carried out for companies outside Spain, with limited Spanish-client activity only under the applicable rules. The applicant must prove the professional or employment relationship, the company’s activity, qualifications or experience, income and social-security position.
Remote work is not synonymous with passive income. If the real plan is to stop working and live from savings or investments, examine the non-working residence category instead. If the plan is employment by a Spanish company, use the appropriate work route.
Study and non-working residence serve opposite purposes
Study
A study visa is based on admission to an eligible programme and evidence of funds, insurance, health and academic purpose. Work permissions and later modifications depend on the current student rules. Confirm the programme’s status and the post-study possibilities before paying tuition.
Non-working residence
Non-working residence is for applicants with sufficient means who will not carry out work. It should not be presented as a remote-worker route. The financial evidence must show lawful, reliable resources under the current consular formula, and private health insurance must meet the published conditions.
Family routes
Family of a Spanish citizen, family of another EU citizen and family of a non-EU resident can fall under different regimes. Select by the sponsor’s citizenship and status. Marriage, birth and dependency evidence may need legalisation and sworn translation.
Where a sponsor in Spain must obtain initial authorisation, wait for the official decision and then follow the consular visa deadline. Do not assume that a tourist trip can replace the prescribed family procedure.
Document and arrival matrix
| Stage | Evidence to control | Common mistake |
|---|---|---|
| Before filing | Prior Spanish authorisation, appointment and correct consular jurisdiction | Booking a national visa under a short-stay service |
| Identity | Passport, civil records, consistent names and photographs | Ignoring differences across Nigerian records |
| Admissibility | Police and medical certificates where required | Ordering them too early and letting them expire |
| Resources | Route-specific income, savings, contract or sponsorship evidence | Using unexplained deposits |
| After arrival | Entry proof, address registration, social security and foreigner identity card | Missing the TIE or registration deadline |

Compare three routes that applicants often confuse
A software professional working remotely for a foreign employer may fit international telework if the company relationship, experience, income and social-security evidence satisfy that route. The same person accepting a Spanish employer’s contract normally needs an employment route instead. Someone living from investments without working should investigate non-working residence.
These categories can produce similar lifestyles but rely on different facts. Using foreign payslips for a non-working application can contradict the declared intention not to work. Using savings alone for telework does not prove an active professional relationship. A Spanish offer does not become foreign remote work merely because the job can be performed from home.
Write a one-sentence activity statement before choosing: who pays you, where the payer is established, what work you perform, and whether you will work for Spanish clients. Match that answer to the official category and keep it consistent across contracts, bank records and the application form.
Recheck the category if any of those facts changes before the decision.
Immigrating to Spain from Nigeria FAQ
Can I work remotely on Spain’s non-working residence visa?
The non-working category is intended for residence without work. Applicants planning active remote employment should assess the international telework route instead.
Does my Spanish employer apply first?
For many employee routes, the employer or representative obtains prior authorisation in Spain. Other highly qualified categories use their own competent unit and sequence.
What is the TIE?
The foreigner identity card documents a qualifying stay or residence in Spain. Many national-visa holders must apply after arrival within the period specified for their status.
Can a student change to a work status?
Spanish law provides modification routes in qualifying circumstances, but graduation alone does not guarantee one. Check the current education, job and timing conditions.
May I use private travel insurance for a residence visa?
Some residence categories require health insurance with specific coverage and authorised-provider conditions. A short-trip policy may not satisfy the checklist.
Which Spanish office handles Nigerian applications?
It depends on consular jurisdiction and visa category. Use the Embassy in Abuja or Consulate General in Lagos page identified for the applicant’s residence and route.
